1. Overview

The present website with the URL https://shop.musicworks.gr/ is the online store for the sale of products of the sole proprietorship “Angeliki Dionysiou Kakolyri” (trade name Music Works), headquartered at 74 Agias Lavras Street, Postal Code 13231, Petroupoli, Attica, with Tax Identification Number 072590149, with GEMI number 180528303000 (member of the Athens Chamber of Tradesmen), tel. +302105055255, e-mail: info@musicworks.gr.

The online store https://shop.musicworks.gr/ (hereinafter “shop.musicworks.gr”) is hosted and operates on the international e-commerce platform Shopify Inc., complying with the provisions of Consumer Protection Law and the applicable legislation governing electronic commerce.

In the present text, the terms of use of shop.musicworks.gr are explicitly and clearly stated.

2. Definitions

a) Visitor: The internet user who enters and browses shop.musicworks.gr without logging into a User account or placing an order.

b) User: The internet user who creates an account on shop.musicworks.gr without placing an order.

c) Customer: The Visitor/User who orders the products available for sale on shop.musicworks.gr.

3. Application of Terms of Use

a) These Terms of Use concern and apply to Visitors/Users/Customers during browsing and use of shop.musicworks.gr.

b) Every Visitor/User/Customer who enters and uses the services of shop.musicworks.gr is considered to consent to and unconditionally accept the terms stated herein, including any additional terms, conditions and policies referenced herein and/or available via link, without any exception. If any Visitor/User/Customer does not agree with these terms, they must refrain from using shop.musicworks.gr and from any transaction with it.

4. TERMS OF USE

4.1 General terms

a) Every Visitor/User/Customer of shop.musicworks.gr, by accepting these Terms of Use, declares that they are an adult, i.e. have reached the age of 18 and are legally capable of concluding a contract for the purchase of products with shop.musicworks.gr. The registered User/Customer agrees to prohibit any use of shop.musicworks.gr by minors who use their account or name, even if they have their consent. In any other case, the purchase of products from shop.musicworks.gr is invalid.

b) Responsibility for the data entered by Users/Customers of shop.musicworks.gr in order forms or communication forms belongs exclusively to them. Users/Customers agree that they will provide valid, complete and accurate purchase and account information for all purchases made, without violating the law (see paragraph d below). They also agree to promptly update their account and other information, such as email address, shipping addresses and phone number, so that transactions are carried out without errors and shop.musicworks.gr can contact them when necessary. The administrators of shop.musicworks.gr do not perform any kind of correction or intervention on the data transmitted by the User/Customer during interaction with shop.musicworks.gr.

c) shop.musicworks.gr considers that each User/Customer who enters personal data in order and message forms is the person to whom such data relates. shop.musicworks.gr cannot and is not obliged to verify the identity of the person entering the data, therefore bears no responsibility for it. The User who enters personal data concerning a third party is liable towards shop.musicworks.gr and towards the third party concerned. The Visitor/User expressly accepts and acknowledges the exemption of liability of shop.musicworks.gr and accepts that they bear full responsibility for their actions and the resulting obligation to compensate any injured party. In such cases, shop.musicworks.gr reserves the right to deny access to the Website and/or delete the account and published information.

d) Access to shop.musicworks.gr is carried out by sending a one-time code to the email declared by each User/Customer during registration, for maximum possible security against password interception. The activity carried out by any logged-in User/Customer binds them fully as the person who entered and used shop.musicworks.gr, even if such activity is performed by others (e.g. persons living with them). Each User/Customer bears exclusive responsibility for securing access to their email and for any damage caused due to unauthorized use of that email.

e) Visitors/Users/Customers are prohibited from transmitting or publishing data:
(a) for any unlawful purpose,
(b) to incite others to perform unlawful acts,
(c) to violate laws or regulations,
(d) to infringe intellectual property rights,
(e) to harass, insult, defame, discriminate, etc.,
(f) to submit false information,
(g) to transmit viruses or malicious code,
(h) to collect personal data of others,
(i) for spam/phishing/scraping,
(j) for obscene or immoral purposes,
(k) to bypass security systems.

στ) shop.musicworks.gr reserves the right to limit product sales to any person or geographic region.

4.2 Payments

a) The online store shop.musicworks.gr operates on Shopify. Payments processed automatically include PayPal, credit/debit cards, Apple Pay, Google Pay.

b) For greater protection against illegal card use, if payment is made by card and store pickup is selected, collection is not allowed in less than 24 hours unless ID is shown.

c) Other payment methods:

Payment by bank transfer must be completed within 3 days from the date of the order; otherwise, the company reserves the right to cancel the order.

d) These payments are confirmed manually. Confirmation is sent once funds are received.

4.3 Shipping

a) Shipping takes place on the first working day (except Monday) after the order. We ship with ACS Courier and DHL Courier.

b) Smart lockers are available for orders less than 70€.

c) Pickup points are chosen based on proximity unless otherwise specified.

d) Combined shipments: one shipping cost, with options for split delivery.

e) Store pickup for paid orders requires showing confirmation email.

στ) Pickup only during store hours.

4.3 Returns and refunds

Terms are available in the refund policy.

4.4 Modifications

shop.musicworks.gr may modify, suspend, or discontinue operation at any time without notice.
It may also change prices, descriptions, availability, shipping costs.
Continued use implies acceptance of changes.

4.5 Personal data

Submission of personal data is governed by the Privacy Policy.

4.6 Disclaimer – Limitation of Liability

a) Card payments bind the legal cardholder regardless of who uses the card. Unauthorized use does not release liability.

b) Third-party links: no responsibility for third-party content/services.

c) Inaccuracies: product images may not perfectly reflect actual items. No liability for discrepancies.

d) Supply chain disruptions: no liability for force majeure events.

e) Defective products: see separate terms.

4.7 Intellectual property

a) All content (text, graphics, logos) is intellectual property of shop.musicworks.gr.

b) Product images are sourced legally and do not infringe copyright.

4.8 Violation of terms

Violation results in legal consequences and possible account termination without notice.

4.9 Account termination

Obligations remain after termination.
Users or the company may terminate the agreement at any time.
Non-compliance may result in immediate termination and denial of access.

4.10 Applicable law

These Terms are governed by Greek law.
