1. Overview

The website located at https://shop.musicworks.gr/ is the online retail store of the sole proprietorship “Kakolyri Angeliki Dionysiou” (trade name: Music Works), headquartered at Agias Lavras 74, 13231 Petroupoli, Attica, VAT No. 072590149, GEMI No. 180528303000, member of the Athens Chamber of Tradesmen.

The online store shop.musicworks.gr is hosted and operated on the international e‑commerce platform Shopify Inc., in compliance with Greek and EU Consumer Protection Law and all applicable legislation governing electronic commerce.
These Terms of Use set out clearly and explicitly the conditions governing the use of shop.musicworks.gr.

2. Definitions

  • Visitor — Any internet user who accesses and browses shop.musicworks.gr without logging into a User account or placing an order.
  • User — Any internet user who creates an account on shop.musicworks.gr without placing an order.
  • Customer — Any Visitor/User who places an order for products offered for sale on shop.musicworks.gr.

3. Scope of the Terms of Use

a) These Terms of Use apply to all Visitors, Users and Customers when accessing or using shop.musicworks.gr.
b) By accessing or using any part of the website, the Visitor/User/Customer is deemed to have fully and unconditionally accepted these Terms, including any additional terms, conditions or policies referenced herein or made available via hyperlink.
Anyone who does not agree with these Terms must refrain from using the website and from engaging in any transaction with it.

4. Terms of Use

4.1 General Provisions

a) By accepting these Terms, every Visitor/User/Customer declares that they are an adult (18+) and legally capable of entering into a purchase agreement with shop.musicworks.gr.
A registered User/Customer agrees to prevent minors from using shop.musicworks.gr through their account or name, even with their consent. Any purchase made in breach of this condition is considered invalid.

b) Users/Customers bear sole responsibility for the accuracy and completeness of the information they submit in order or contact forms. They agree to provide valid, complete and accurate purchase and account information and to promptly update their details (email, shipping address, telephone number) to ensure error‑free transactions and effective communication.
The administrators of shop.musicworks.gr do not alter or interfere with any data submitted by Users/Customers.

c) shop.musicworks.gr assumes that the person submitting personal data is the data subject. The website cannot and is not obliged to verify identity; therefore, it bears no liability for incorrect or third‑party data.
Any User submitting personal data of a third party is solely liable towards both shop.musicworks.gr and the third party.
The Visitor/User expressly acknowledges and accepts this limitation of liability and bears full responsibility for any resulting damages.
In such cases, shop.musicworks.gr reserves the right to deny access or delete the User’s account.

d) Login to shop.musicworks.gr is performed via a one‑time password (OTP) sent to the User’s registered email address, ensuring maximum protection against credential theft.
Any activity conducted under a logged‑in email address is deemed to have been performed by the User themselves, even if carried out by others.
Users bear exclusive responsibility for safeguarding access to their email and for any damage caused by unauthorized use.

e) Visitors/Users/Customers are strictly prohibited from transmitting or publishing data that:
– serve illegal purposes;
– encourage unlawful acts;
– violate laws, regulations or ordinances;
– infringe intellectual property rights;
– constitute harassment, abuse, defamation, discrimination or intimidation;
– contain false or misleading information;
– include viruses or malicious code;
– attempt to collect personal data of others;
– involve unsolicited communications, phishing or data harvesting;
– are obscene or immoral;
– interfere with or circumvent security features of the website or related systems.

f) shop.musicworks.gr reserves the right to restrict sales to any person or geographic region, at its discretion.

4.2 Payments

a) shop.musicworks.gr operates on the Shopify platform. Payments automatically processed within Shopify’s secure environment include PayPal, credit/debit card payments, and Google Pay.

b) To prevent unauthorized card use, if an order is paid by card and the Customer selects in‑store pickup, collection is not permitted within 24 hours, unless the recipient presents valid identification.

c) Additional payment methods:
– Bank transfer (Piraeus Bank or Viva Wallet)
– Iris Payments
– Cash on delivery (payment to the courier)
– Payment and pickup at the physical store

Bank transfers must be completed within 3 days; otherwise, the business may cancel the order.

d) Payments under paragraph (c) are confirmed manually. Confirmation is sent once funds appear in the business account. Payments made outside working hours or from other banks may be visible with delay.

4.3 Shipping

a) Orders are dispatched on the next working day, except Monday. Couriers: ACS and DHL.
b) ACS Smartlocker delivery is available for parcels up to 1 kg.
c) For ACS store/locker pickup, the nearest location to the Customer’s address is selected unless otherwise specified.
d) If an order contains both in‑stock items and items available in 3–25 days, shipping is charged once. After consultation, the Customer may choose:
– a single shipment when all items arrive, or
– immediate shipment of available items and a second shipment free of charge.
e) Prepaid orders collected in‑store require presentation of the purchase confirmation email.
f) In‑store pickup is available only during store hours.

4.4 Returns and Refunds

The terms governing product returns and refunds are set out in the Refund Policy.

4.5 Modifications to the Online Store

a) shop.musicworks.gr may modify, suspend or discontinue its operation at any time for maintenance, upgrades or improvements, without prior notice, subject to Customers’ statutory rights.
b) shop.musicworks.gr may change product prices, descriptions, availability and shipping costs at any time, without prior notice, subject to Customers’ statutory rights.
c) New features or tools added to the website are also governed by these Terms. Continued use of the website after any changes constitutes acceptance of those changes.

4.6 Personal Data

Submission of personal data through shop.musicworks.gr is governed by the Privacy Policy.

4.7 Disclaimer of Warranties – Limitation of Liability

a) Card payments
Payment by credit/debit card (via PayPal) binds the lawful cardholder, regardless of who uses the card. Unauthorized card use does not release the lawful cardholder from liability, nor from any claims by shop.musicworks.gr.

b) Third‑party links
The website may contain links to third‑party sites. shop.musicworks.gr is not responsible for evaluating their content or accuracy and bears no liability for any damages arising from transactions with third‑party websites.

c) Inaccuracies, errors, omissions
Record cover images may not always perfectly reflect the physical product due to supplier‑provided images. Identification is based on barcode and tracklist. Historical information in product descriptions is provided for general information only.

d) Supply chain disruptions
shop.musicworks.gr is not liable for delays or shortages caused by force majeure, courier failures, platform malfunctions (Shopify, PayPal), banking issues, or illegal third‑party actions.

e) Defective products

4.8 Intellectual Property

a) All text, graphics, photographs (excluding product images), and logos on shop.musicworks.gr constitute intellectual property protected under Law 2121/1993 and applicable national and international provisions.
b) Product images are legally sourced from suppliers, original photography, or licensed databases (e.g., MusicBrainz, Discogs).

4.9 Breach of Terms

Any breach of these Terms by a Visitor/User/Customer may result in legal consequences and liability for damages.
shop.musicworks.gr reserves the right to deny access, delete accounts, and remove posted information in cases of violation.

4.10 Account Termination

Any obligations and liabilities incurred by the parties prior to the termination date shall survive the termination of this agreement for all purposes.

These Terms of Service remain in effect unless and until terminated by either you or us.
You may terminate these Terms at any time by notifying us that you no longer wish to use our Services, or by ceasing to use our website.

If, in our sole judgment, you fail or we suspect that you have failed to comply with any term or provision of these Terms of Service, we may terminate this agreement at any time without notice. You will remain liable for all amounts due up to and including the date of termination, and we may also deny you access to our Services (or any part thereof).

These Terms of Use shall be governed by and interpreted in accordance with the laws of Greece.
